Workplace Violence Investigations

 

Current legislation creates new rights for employees as well as new requirements for employers and management.   Employers must keep records about persons with a history of violence and must provide this information to those who may encounter these persons in the course of their duties and who may be at risk of injury as a result of workplace violence.  Employers must put in place new policies and programs that deal with workplace violence and harassment which must include measures to assess and control risks.  Employers are now mandated to provide information to employees which informs them how to get immediate help, including measures and procedures for workers to report incidents of workplace harassment to the employer, manager or supervisor.  Legislation requires the employer to inform how incidents will be investigated and dealt with. Once the employer becomes aware, that domestic violence that would likely expose a worker to physical injury may occur in the workplace, the employer shall take every precaution reasonable in the circumstances for the protection of the worker.

Physical Security Audits

 

Physical Security Audits are a comprehensive inspection and evaluation, conducted by experienced and trained security professionals, of all the physical security measures your commercial, industrial, organizational, retail, office complex or residence has in place.  The goal of the Physical Security Audit is to identify any and all weaknesses, in the security of your premises.

Employment, Workplace & Labour Law Investigations

 

Ontario employers have certain obligations under various Provincial legislation to conduct a reasonable workplace investigation.  Whether or not a workplace investigation requires an external investigator, depends on the severity and circumstances.  Regardless if you employ an external investigator, a workplace investigation must be conducted in a fair, unbiased and professional manner, that follows guidelines as evolved by the courts. 

 

Employee workplace investigations may result in employee discipline, employee termination and even litigation, and thus, your investigation must be able to withstand scrutiny and procedural fairness owed to both the accused and complainant. 

The Ministry of Labour works to establish and enforce employment standards, prevent workplace injuries, illnesses and deaths, and handle workplace disputes in Ontario.  There are numerous regulations set forth by the Ministry that employers are legally obligated to abide by, all of these regulations carry with them their own set of consequences if employers fail to comply with them. For example, not being compliant with the Occupational Health and Safety Act (OHSA) can result in fines up to $100,000 and an imprisonment term of up to 12 months.  Even if you have complied fully with the legislation, an accident or death can still occur, and not only could you be charged under the Occupational Health and Safety Act, you could also be criminally liable and charged under the Criminal Code of Canada under Section (220) Criminal Negligence Causing Death, Section (221) Criminal Negligence Causing Bodily Harm, as well as other sections.
